Terms Of Use​

These Terms & Conditions (“Terms”) govern your use of the UltiBudget mobile app and website (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1) About UltiBudget
UltiBudget is a personal budgeting tool for tracking spending and organizing transactions. It is not accounting software, and does not provide financial, investment, tax, or legal advice.
2) Eligibility; Platform
UltiBudget is available on iOS. You must be at least 13 years old (or the minimum age required in your jurisdiction).
3) Changes to These Terms
We may update these Terms at any time. Because we do not collect contact information, we cannot notify you directly. The “Effective Date” above will change, and updates will be posted in-app and on our website. Your continued use after an update means you accept the revised Terms.
4) Data Storage & Backups
Your budgeting data (e.g., categories, transactions, receipts) is stored on your device and/or in your personal Apple iCloud account (if you enable iCloud for the app). We do not host your data on our own servers and generally cannot access it. If you delete the app, lose your device, or lose iCloud access, your data may be permanently lost. Export and back up your data regularly. We cannot recover lost data.
5) Collaboration / Sharing
Shared workspaces via iCloud/CloudKit are temporarily unavailable. If reintroduced, you will control who can access a shared workspace and may revoke access at any time. You are responsible for the consequences of granting access to others.
6) Subscriptions, Pricing & Refunds
UltiBudget is free today and contains no in-app purchases at this time. We may introduce paid features or reintroduce UltiBudget+ in the future. Any purchases, cancellations, and refunds will be handled solely by Apple under App Store rules; we do not process or store payment information.
7) Acceptable Use
You agree not to:

use the Service for unlawful, fraudulent, or harmful purposes;

access or use the Service in a way that could damage, disable, or impair it;

reverse engineer, decompile, or circumvent security or usage limits;

scrape, harvest, or resell the Service or its outputs; or

interfere with others’ use of the Service.
We may suspend or terminate access for violations.
8) Intellectual Property; User Content
We (and our licensors) own the app, site, logos, software, and related IP. You own your budgets, transactions, and receipt images you input. You grant us a non-exclusive license to process that content solely to operate and improve the Service.
9) Feedback
If you send suggestions or ideas, you grant us a perpetual, irrevocable, royalty-free right to use them without obligation to you.
10) Third-Party Services
The Service may rely on Apple services (e.g., iCloud, App Store). Apple is not responsible for the Service, and we are not responsible for third-party terms or availability.
11) Availability; Changes; Deprecation
We may add, change, or remove features (including re-enabling or replacing sync/sharing) and may discontinue the Service at any time without notice. Uptime is not guaranteed. Export your data regularly.
12) No Professional Advice; At-Your-Own-Risk
Information in the Service is provided “as-is” for budgeting convenience only and may be incomplete or inaccurate. You are solely responsible for financial decisions.
13) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant accuracy, reliability, availability, or error-free operation.
14) Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data; lost profits; service interruptions; or acts/omissions of third parties or collaborators. Our total liability for any claim is limited to US$50.
15) Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of your use of the Service or violation of these Terms.
16) Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-laws rules.
17) Arbitration; Class-Action Waiver
Binding Arbitration. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis.
Forum & Rules. The arbitration will take place in Michigan (or by video/teleconference, if available) before a single arbitrator, under the applicable consumer arbitration rules of a reputable provider (e.g., AAA or JAMS).
Small-Claims Carve-Out. Either party may bring an individual claim in small-claims court in Michigan.
Class/Jury Waiver. No class, collective, or representative actions. You and we waive any right to a jury trial.
Injunctive Relief. Either party may seek temporary or injunctive relief in court to protect confidential information or intellectual property.
18) Termination
You may stop using the Service at any time. We may suspend or terminate access immediately for any breach of these Terms, unlawful activity, or to comply with law. Upon termination, your right to use the Service ends.
19) Entire Agreement; Severability; Assignment
These Terms are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. We may assign these Terms; you may not assign without our consent.
